Before placing a bid, buyers should carefully review the complete auction listing and understand the item being offered.
Buyers are responsible for conducting appropriate due diligence before placing a bid.
A bid represents a buyer's genuine intent to purchase the item if the buyer becomes the winning bidder.
Users should carefully review the bid amount before submitting a bid. Users are responsible for activity conducted through their accounts.
Users may not place fraudulent, artificial, or manipulative bids, including bids made without genuine intent to purchase.
The applicable bid amount and auction information are displayed through the BidFlag Platform.
Buyers should review the amount displayed before submitting a bid and should not rely on information outside the Platform when determining the current auction status.
Each auction operates according to the auction settings displayed on the BidFlag Platform.
Buyers should rely on the auction information displayed by BidFlag regarding the applicable auction status and closing information.
A user who is the winning bidder is required to complete the resulting purchase in accordance with the BidFlag Terms & Conditions and applicable transaction requirements.
A winning bidder is required to complete payment within twenty-four (24) hours of winning the bid.
Failure to complete a legitimate winning transaction may result in action under the applicable BidFlag policies.
Sellers are responsible for ensuring that auction listings accurately represent the items being offered.
Sellers may not list items that are not in their possession or otherwise lawfully available for fulfillment.
Bid manipulation is prohibited. Users may not attempt to artificially influence an auction's price or outcome.
BidFlag may cancel transactions, remove listings, or restrict accounts where fraud, manipulation, or other abuse is suspected.
Sellers may not use BidFlag auctions to list items prohibited under the BidFlag Terms & Conditions or applicable law.
This includes firearms, weapons and ammunition, pornography or unlawful sexual material, illegal drugs and controlled substances, stolen property, human remains, live animals and pets, hazardous substances, explosives and fireworks, prohibited fuels, liquid mercury, prohibited lithium-battery products, automobile airbags and restricted safety equipment, cigarettes and tobacco products, alcoholic beverages, counterfeit goods, prohibited lottery-related materials, and other prohibited goods or materials identified by BidFlag, applicable law, carriers, or payment providers.
Sellers are responsible for reviewing the applicable prohibited item requirements before creating an auction.
Where an auction includes a reserve price, the reserve represents the minimum price established by the seller for the applicable auction.
Where applicable, the Platform may indicate whether the reserve has been met.
Following a successful auction and completed sale, the seller must fulfill the transaction in accordance with the BidFlag Terms & Conditions.
The seller must dispatch the item within seven (7) days, unless BidFlag authorizes otherwise.
If the seller fails to fulfill the transaction within the required period, the buyer may be entitled to a full refund, including applicable shipping charges, subject to BidFlag's applicable procedures.
Auction purchases remain subject to the applicable BidFlag return and refund requirements.
BidFlag recommends that sellers provide a minimum fourteen (14) day return period.
A seller may offer a “No Returns” policy where legally permitted, provided that the policy is clearly disclosed in the listing at the time the item is posted.
A “No Returns” policy does not excuse fraud, material misrepresentation, unlawful conduct, or obligations that cannot legally be excluded.
A winning bidder is obligated to complete payment through the Platform within twenty-four (24) hours of winning the bid.
Users who repeatedly fail to complete legitimate winning transactions may be subject to account restrictions, suspension, or termination in accordance with the BidFlag Terms & Conditions.
Auction transactions must remain within the BidFlag website and associated application.
Users may not circumvent BidFlag's transaction system by arranging payment or completing transactions outside the Platform.
Violations may result in cancellation, removal of listings, suspension, or permanent termination of the user's account.
Transactions are primarily between buyers and sellers. BidFlag is not a party to disputes between users unless it expressly elects to participate or is legally required to do so.
Users should provide relevant transaction and auction information when contacting BidFlag regarding an auction issue.
BidFlag may review transaction information and take appropriate action where Platform rules have been violated.
BidFlag may remove listings, cancel transactions, restrict access, suspend accounts, or terminate accounts for violations of the Terms, applicable law, fraud, abuse, or conduct that threatens the Platform or its users.
BidFlag may also cooperate with law enforcement or other authorities where appropriate or legally required.
